Terms of Service

By accessing or using Waitly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. The Service

Waitly provides tools to create waitlist pages, collect subscriber email addresses, manage referral programs, and send broadcast emails. The Service is operated by Aymane (the "Operator").

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited emails, or misleading communications
  • Collect emails without the knowledge or consent of subscribers
  • Violate any applicable law or regulation
  • Upload or transmit malicious code or content
  • Impersonate any person or entity
  • Abuse the referral system or any other feature of the Service

You are responsible for all content you send through the Service, including broadcast emails. You must include a valid unsubscribe mechanism in all marketing emails (this is handled automatically by the Service).

4. Subscription and Payment

Access to certain features requires an active paid subscription. Billing is processed through Lemon Squeezy. By subscribing you also agree to Lemon Squeezy's Terms of Service.

Subscriptions are billed on a recurring monthly basis. You may cancel at any time through the billing portal; access continues until the end of the current billing period.

We reserve the right to change pricing with reasonable notice. Price changes will not apply to your current billing cycle.

5. Refunds

We offer a 7-day refund policy for new subscriptions. To request a refund, contact us within 7 days of your initial payment. Refunds are not available for renewals.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you upload to the Service. You grant us the right to process that data solely to provide the Service.

As a user who collects email addresses from third parties via waitlist pages, you are the data controller for those subscribers. You are responsible for ensuring you have a lawful basis to collect and use their data.

7. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting us.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

9. Limitation of Liability

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
